Not all services are provided directly by IFFPF Inc., as some are offered through third parties that do business with IFFPF Inc. on a referral basis. For this IFFPF Inc. receives a commission. IFFPF Inc. is not a licensed Real Estate Broker and receives no commission on referred out Real Estate Sales or Leases where a Real Estate Brokers License is needed to be paid a commission. However in such cases IFFPF Inc. will refer the contact to PRUDENTIAL ZACK SHORE PROPERTIES, 605 Lake Ave., Asbury Park, NJ 07712, a New Jersey Licensed Real Estate Brokerage and PRUDENTIAL ZACK SHORE PROPERTIES will earn a referral commission. Paul Hauke, President of IFFPF Inc. is a licensed sales associate with PRUDENTIAL ZACK SHORE PROPERTIES and will be paid a percentage of the commission earned by PRUDENTIAL ZACK SHORE PROPERTIES. In the state of New Jersey all Real Estate listings and sales will be with PRUDENTIAL ZACK SHORE PROPERTIES, with Paul Hauke being the listing agent. Paul Hauke will earn a percentage of the commission earned by PRUDENTIAL ZACK SHORE PROPERTIES. IFFPF Inc. is not an insurance broker and does not refer insurance business and does not receive any commissions from any insurance brokers advertising on the ezeinsurance.com (tm) site. IFFPF Inc. is not a residential mortgage banker/broker and does not refer residential mortgage business and does not receive any commissions from any residential mortgage bankers/brokers advertising on the ezrealtymortgage.com (tm) site IFFPF Inc receives a commission from all other business referred out, such as: asset based lending, cash for privately held seller carry back paper and notes, buyers of profitable C corporations, affiliate programs, and vehicles sold through ezautdealers.com. IFFPF Inc. is not a lender, auto seller or leasor, note buyer, real estate broker, insurance broker, or buyer of C Corporations and does not endorse or recommend the products or services of any of the above that you choose to do business with. IFFPF Inc. does not make loans or credit decisions in connection with any of the above, nor does IFFPF Inc. issue committments. IFFPF Inc. is not an agent of either you, the consumer; any affiliate, or any participating lender or loan broker, note buyer, auto dealer, insurance broker, or C Corporation buyer (we refer to all these as "advertisers") . IFFPF Inc. is not an agent of either you, the consumer, or any participating Real Estate Broker or Insurance Broker. IFFPF Inc.’s services are adinistrative and consultative only. You should rely on your own judgement in all decisions. You are under no obligation to use IFFPF Inc. or advertisers. IFFPF Inc. does not guarantee that completing the paperwork for any of these services will result in your receiving a loan, an offer or promsie for a loan commitment or interest rate lock in agreement, the purchasing or leasing of a new or used vehicle, the sale of your privately held note, the lsiting or sale of any real estate, the issuance of any insurance, or the sale of your C Corporation, or the participationin any affiliate program. IFFPF Inc. is not engaged in the residential home loan business and does not refer out home loan business. Any loan request submitted for a residential home loan is automatically null and void and will not be accepted. Loan requests submitted to IFFPF Inc. for assest based loans, private notes for sale, auto purchases or leases, mortgages, etc. are not aplications for credit. Rather, it is a request for a loan prequalification. You represent that all of the information you have provided in your loan request is true and complete. By submitting the loan request you authorize IFFPF Inc. to check your credit history. You also authorize IFFPF Inc. to share this informatin with Lenders or other third parties who need to know this information. You may have to complete an application with a Lender before they will extend an uncondtional loan offer. Real Estate Brokers and Insurance Brokers deal directly with you the consumer. A Lender may require you to pay an appliction fee to cover the cost of an appraisal, credit report or other items. The Lender will determine the amount of any such fees, and should provide information to you regarding the refundability of any such fees. IFFPF Inc. does not charge you the consumer, any fees for loan requests. IFFPF Inc. receives its compensation from the Lenders for the goods, facilities and services actually provided by IFFPF Inc. IFFPF Inc. does not researh the status of title or presence of existing liens for any personal or business property used to secure private loan transactions. Borrower/Buyer and Lender are solely responsible for assuring that requirements under any state or federal laws that may apply to the transaction have been met, including the preparation of any disclosures, notices or othe documents required by state or federal law, and for determining the terms and that the terms are in compliance with any local, state, or federal laws, including but not limited to laws relating to usury, both federal and state income tax, sales taxes, etc. IFFPF Inc. does not endorse, accept liability for, or participate in the creation of the terms of any contract, agreement or other arrangement, whether lawful or illicit, reached between the parties. This discalimer applies equally to any business between you and any Real Estate Broker or Insurance Broker on our web site (s). All other business contracted between you and IFFPF Inc., and not referred out, will be subject to, in addition to these terms and conditions, the terms and conditions of the contract between you directly and IFFPF Inc. In case of a dispute between these terms and conditions and the terms and conditions of the contract between you and IFFPF Inc., the tems and conditions of the contract between you and IFFPF Inc. will rule. As such fees are paid directly to IFFPF Inc. in accordance with contract between you and IFFPF Inc. You may be required to submit information, the same as outlined above and identified as a loan request. Upon submitting same you authorize IFFPF Inc. to check your credit history and to share such history with third parties who need to know. All merchandise, products and services are sold "as is" with no warranty express or implied. All sales are final. No refunds. Credit or exchanges only within ten days of product delivery or sevice completion, with prior approval by, and at the sole discretion of IFFPF Inc. All accounts with past due balances of over thirty days are subject to an additional late fee charge of 18%, compounded monthly on the outstanding balance. You agree that IFFPF Inc. shall not be liable for any damages or costs of any type arising out of or in any way connected with your use of any proudcts or services of this web site. IFFPF Inc. and/or participating lenders , and advertisers expressly reserve the right to discontue, suspend or terminate any program or product at any time, for any reason, and without prior notice. IFFPF Inc. is not responsible for any errors or delays in responding to a qualification form or referral form caused by an incorrect e mail address provided by you or other technical problems beyond our reasonable control. Any claims or controversy arising out of or relating to the use of this web site, to the goods or services provided by IFFPF Inc., or to any acts or omissions for which you may contend IFFPF Inc. is liable, including but not limited to any claim or controversy as to arbitrability ("dispute"), shall be finally, and exclusively, settled by arbitration. the arbitratiion shall be held before one arbitrator and the commercial arbitratiion rules of the American Arbitration Association ("AAA") in force at that time. The arbitration shal be venued in Ocean County, New Jersey. The arbitrator shall be selected pursuant to the AAA rules. Should no AAA rule regarding the selection of an arbitrator be in effect, the conusmer shall select an arbitrator from a panel of no more than five arbitrators acceptable to IFFPF Inc. In any arbitration, the filing fee and the cost associated with the arbitration is to be evenly split between IFFPF Inc. and the party making the request for arbitration. To begin the arbitration process, party must make a writen demand therefor. Any judgment upon the award rendered by the arbitrtors may be entered in any court of competent jurisdiction in Ocean County, New Jersey. The arbitrators shall not have the power to award damages in connection with any dispute in excess of actual compensatory damages and shall not multiply actual damages or award consequential, punitive or exemplary damages, and each party irrevocably waives any claim thereto. The agreement to arbitrate shall not be constured as an agreement to the joinder or consolidation of an arbitration under this agreement with an arbitration of disputes or claims of any non-party, regardless of the nature of the issues or disputes involved. THIS AGREEMENT PROVIDES THAT ALL DISPUTES BETWEEN YOU AND IFFPF INC. WILL BE RESOLVED BY BINDING ARBITRATION. YOU THUS GIVE UP YOUR RIGHT TO GO TO COURT TO ASSERT OR DEFEND YOUR RIGHTS. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS. YOUR RIGHTS WILL BE DETERMINED BY NEUTRAL ARBITRATORS AND NOT A JUDGE OR JURY. You are entitled to a fair heearing, but the arbitration procedures are simpler and more limited than rules applicable in court. Arbitrator decisions are enforceable as any court order and are subject to very limited review by a court. By using IFFPF Inc’s goods and services and those of its advertisers you consent to these restrictions. Should a dispute arise and should the arbitration provisions herein become inapplicable or unenforceable, or in any instance of any lawsuit between you and IFFPF Inc. the parties agree that juridiction over and venue of any suit shall be exclusively in the state and federal courts sitting in Ocean County, New Jersey. If either party employs attorney’s to enforce any right in connection with any dispute or lawsuit the prevailing party shall be entitled to recover reasonable attorney’s fees. This agreement constitutes the entire agreement between you and IFFPF Inc. and it supersedes all prior or contemporaneous communications promises and proposals, whether oral, written or electronic, between you and IFFPF Inc. with respect to this web site(s) and information, software, products and services associated with it. This agreement shall be subject to and construed in accordance with the laws of the state of New Jersey, If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitaions set forth above, then the invalid or unenforceable provision will be deeded superseded by a valid enforceable povision that most closely matches the intent of the original provision, and the remainder of the agreement shall continue in effect. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. All rights not expressly granted herein are reserved. All claims (excluding requests for injunctive or equitable relief) between the parties must be resolved using the "BINDING ARBITRATION" dispute resolution mechanism as outlined above. To begin the arbitratiion process, one party must make a written demand therefor. Should either party file an action contrary to this, the other party may recover attorneys’ fees and costs up to $5,000. USD, provided that the party seeking the award has notified the other party in writing of the improperly filed claim, and the other party has failed to withdraw the claim. You may not transfer any rights or obligations you may have under this agreement with out the prior written consent of IFFPF Inc. IFFPF Inc. reserves the right to transfer this agreement or any right or obligation under this agreement without your consent. All services , programs , opportunities, and goods offered on this site and licensed sites are void where prohibited.
